“Where The Elite Play Ball”
Force Majeure. National Youth Championship Bowl Series, Urban Elite Athletics and its assignee’s, (hereafter “NYCBS”) shall not be liable in damages or for any default in performing here under if such delay or default is caused by conditions beyond its control including, but not limited to team cancellation, Acts of God, (ie: rain, flood, lightning etc.), Government restrictions (including closing of fields due to weather or field damage), lighting of fields, and/or any other cause beyond the reasonable control of the party whose performance is affected. If the event is cancelled out of the NYCBS Tournaments control there will be no refunds. All teams agree to hold harmless the Officers, Directors, Administration from any potential lawsuit and will pay for all legal fees required to defend the NYCBS and its assignee’s. Any such legal action is restricted to Phoenix, Arizona jurisdiction. If game is cancelled due to rain that game will become a tie in the bracket, because all team merchandise has already been purchased before the tournament starts. Therefore there will be no refunds. Both parties agree that no other claims will be accepted such as Hotel Cost, Transportation Cost, Food Cost, Inconvenience or any liquidated damages resulting from a cancellation of a game or games.
Jurisdiction is limited to the State of Arizona.
